Mayor Pro-Tem Seih open the Public hearing for the FY 2010-2011 Budget at 6:30 p.m. Rice explained to the Council the General levy will stay at $2.00 a thousand and Ag land will be $1.99 a thousand. Sieh asked for any verbal or written comments. No verbal or written comments were received.
Motion/Ladegaard/Paxton to close the Public Hearing at 6:35p.m.
Motion/Paxton/Petersen/carried to accept RESOLUTION NO. 2010-3 adopting the proposed FY 2010-2011 budget.

Representatives Bob Shaw and Julie Scheib of the Discovery Center were present to explain the 2010 Budget. Scheib thanked the Council for their support over the years. Shaw explained the revenue they have received from Cities, grants, and churches. Shaw explained that they had a porch party last year which helped educate the public on what the Discovery Center is and where money is going. According to Shaw it was a successful event.
Due to the Mayor having a conflict with the April 12th Council Meeting, he requested the meeting date be changed to April 14th at 6:30 p.m.
Motion/Petersen/Paxton/carried to change the Meeting date to April 14 at 6:30 p. m.
COMMITTEE REPORT
Street
Rice reported the street by the Vern and Coil’s Park sign had a large crack but believes it is a high pressure sewer line leaking.
Finance
Mayor Pro-tem Sieh introduced the new City employee, Ben Umscheid. Ladegaard stated the City had a lot of qualified applicants. Out of the applicant that were interviewed, the Personnel Committee felt Umscheid was best applicant for the job. Umscheid wages were set at $14.68 per hour.
Park & Rec
Marcia would like to set the April 30 for planting trees along Wheeler Blvd.
Motion/Ladegaard/Petersen/carried to hire Umscheid at a wage of $14.68 per hour.

UNFINISHED BUSINESS
Dog Issue
Seih hopes that we can get this issue resolved. Peggy Lueck feels that they have this issue resolved between them and the Minor’s. Lueck’s Vet had told the Luecks they should check the City ordinances after the attack in December. That when it was reported to Rice. Rice explained to the Luecks that he would have to report this incident to the Council. Lueck’s felt this is something they could of resolved without coming in front of the Council. The Minors had been at last months Council Meeting. Ladegaard felt that the Luecks should have an opportunity to come to the Council and tell their side of the story but didn’t have to if they didn’t want to. The Minors and Luecks feel as neighbors they have resolved this problem. Also it was brought up about other dogs running at large.

NEW BUSINESS
DOG ISSUE
Traughber asked Minor to give his side of the dog issue. Minor asked Traughber what the complaint was. Traughber stated that the Lueck’s, that own White Oaks Campground, stated that in the fall of 2008 Minor’s dog had attacked their dog. Lueck’s stated that their dogs were not on leashes but the Minor’s dogs were on leashes. Luesk’s stated that the Minors could not control their dogs. Luesk at that time incurred a $300.00 vet bill. Then again on December 26th 2009 Minor’s dogs attacked their other dog. Luesk’s didn’t have their dogs on a leash but the Minor’s had their’s on a leash. Lueck’s incurred a $200.00 vet bill at that time. Traughber also stated in the fall of 2006, Tom Johnson’s dog was attacked by Minor’s dogs. Minor stated after that happen they had turned up the intensity of the collars and installed a fence. Deb Peterson stated that it was Minor’s mother’s dog that had crossed the electric fence and the other dogs followed. Deb Peterson stated that when she spoke to Johnson, it was the black dog, not Minor’s 2 blond dogs. Minor again stated that since they installed the fence and turned up the intensity on the collars, they have had no problems. Traughber stated that if Luesk’s would have had their dogs on a leash, this might not have happened. Traughber stated that the Luesk’s had said that the Minor’s could not control their dogs even though they were on leashes. Minor stated he is 260-pound man and the dogs weigh 45 or 50 pounds. Minor stated he could control the dogs. Minor stated he was walking his dogs down the road when the Luesk dog came barking and running towards him. At that time,Luesk’s son came running yelling for the dog. By this time Jeff Luesk had come out and asked Minor how his dogs were. Minor stated his dog was bleeding. Minor asked Luesk how his dog was. Luesk replied by saying he though it was ok. Minor at that time told Luesk he should keep his dogs on leashes. Liz Fovlks stated that she had been walking the Minor dogs when the Luesk’s dogs came running and barking at her. Fovlks stated that the Luesk’s dogs were following them down the road. At that time, the Luesk’s came and got their dogs. In 2009 Deb Peterson was walking their dogs when Luesk’s dogs came running out. At this time, one of the Luesk’s dogs were injured again. Deb Peterson stated that the Luesk’s did not have their dogs tethered. Paula Zenor told the Council how her cat plays with Deb Peterson and Craig Minor’s dogs. Zenor is the first house to the south of Minor’s and stated that they keep their dogs contained to their yard. Minor presented 5 letters from the neighbors describing how their dogs play with Peterson and Minor’s dogs. Traughber wanted the copies of the letters on file with the clerk. Minor stated that the problem is with the Luesk’s dogs. The Luesk’s dogs are the one that charged Minor’s dogs. Minor stated that within a 1 year period Lueck’s dogs have attacked 3 times. Minor referred to the City code, which states 2 attacks within a 1-year period, deems an animal, a vicious animal. Minor stated the Luecks need to put in fences. Minor stated he had already asked the Luecks to put their dogs on leases and that did not happen. Minor stated that the Lueck’s dogs attacked Minor’s dogs. Luesk’s dogs were not on leashes and Minor’s dogs were. Minor would like to see Luesk’s dogs contained. The Council will hear Luesk’s side of the dog issue at the March Council Meeting. This tape is on file with City Clerk for more commits from the Council.

NEW BUSINESS
A Management Agreement between the Iowa Department of Natural Resources and the City of West Okoboji. This Agreement is for the Garlock Slough Trail. Rice explained that the City has an Agreement for maintenance with the Dickinson County Trails. This Agreement is for grant purposes.

COMMITTEE REPORTS
WATER
Rice reminder the Council that Milford will be increasing water rates by 3% this year.
The City’s water main map had not been updated for years. Insurance Services Office needs this map for the fire rating. Rice talked with Brian Schmidt from Kruse, Cate and Nelson about the cost of the update. The cost would be around $1500.00. The Council directed Rice to go ahead with the update of the map.
NEW BUSINESS
Rice reported the Discovery House Representatives would not be able to meet with the Council till the March 8th Meeting
Rice met with Alliant Representatives about the 2010 water and electric project. Rice explained the easements the City will need before going on with the Project. Rice was directed to contact Kruse, Cate and Nelsen about replacing the water main in this area. The City will up grade the water main to an 8” from a 4” in this area with new fire hyd.
RESOLUTION NO. 2010 – This resolution appoints Maahs and Owens Firm at a rate of $150.00 an hour for legal service.
