After the Pledge of Allegiance the Mayor called the meeting to order at 6:30 P.M. Petersen/Ladegaard moved to adopt the agenda. All ayes. Motion carried. Ladegaard/Hein moved to approve minutes from June 12, 2017. All ayes. Motion carried. Paxton/Olson moved to approve the Bank Cash Report for June, 2017. All ayes. Motion carried. Ladegaard/Olson moved to approve Claims for July 2017. All ayes. Motion carried.
Street – Traughber stated a section of Terrace Park Blvd North of the Taco House was buckling. Jason Eckard, Public Works Director is aware of the problem and will continue to monitor the situation there.
Rick Wittrock, City Maintenance was present to introduce himself to the Council.
Water – Mayor Traughber spoke with Eric Stoll, Milford Municipal Utilities General Manager about the Invasive Species charge to the city and its residents. Traughber stated there were 27 months left on payment for that project. Ladegaard asked City Administrator Ballis to put Invasive Species payoff option on the agenda for next month.
Sanitation – Darlene Powers asked the Council if residents were required to use City of West Okoboji garbage bags. She stated some residents/guests were not using them. Mayor Traughber stated that all residents were to use the bags supplied by the City available at City Hall or garbage would not be collected at that property.
Parks & Rec – Mayor Traughber informed the Council the bathrooms at the beach continue to be a problem on a daily basis of toilets plugging. He mentioned Emerson Bay and Trappers Bay State Park have updated facilities that seem to curb this problem. Traughber asked City staff to look into this possibility in the future.
Rebecca Gisel of Alliant Energy to give West Okoboji annual report: Ms. Gisel and Josh Murray were present to represent Alliant Energy and give the Council the city’s annual report. Gisel stated Alliant Energy is a big supporter of economic development and informed the council of the many grant options available to the city. She stated there are numerous programs offered as well and encouraged everyone to visit the website for more information.
Public Hearing for the amendment to the Zoning Ordinances creating a new Section 11.10 Sale of Fireworks Regulations: Mayor Traughber opened the Public Hearing up at 6:47 P.M.; there were no comments from those in attendance or from the public. Traughber closed the meeting.
ZONING ORDINANCE NO. 2017-1 “AN ORDINANCE CREATING A NEW SECTION 11.10 SALE OF FIREWORKS REGULATIONS OF THE WEST OKOBOJI ZONING ORDIANANCE”: The Planning and Zoning Committee met on June 30, 2017 and made the recommendation of creating a new Section 11.10 Sale of Fireworks Regulations to the West Okoboji Iowa Zoning Ordinance. The board has made the recommendation to the City Council to adopt this section. Overall, it relates to regulating the sale of consumer fireworks within the City of West Okoboji to a single story permanent structure building in a commercial zoning district. Motion by Ladegaard, seconded by Paxton, to approve first reading of Zoning Ordinance No. 2017-1. Roll call vote. All ayes. Motion carried.
Waive second and third consideration of Zoning Ordinance No. 2017-1: Motion by Ladegaard, seconded by Petersen, to waive the first and second consideration of Zoning Ordinance No. 2017-1. Roll call vote. All ayes. Motion carried.
ADOPT ZONING ORDINANCE NO. 2017-1: Motion by Ladegaard, seconded by Paxton to adopt Zoning Ordinance No. 2017-1. Roll call vote. All ayes. Motion carried.
ORDINANCE NO. 120 “AN ORDINANCE AMENDING THE CODE OF ORDIANANCES OF THE CITY OF WEST OKOBOJI, IOWA BY ADDING A NEW CHAPTER 8, ENTITLED MUNICIPAL INFRACTIONS.” : Council to review and consider amending the code of ordinances by adding a new chapter regarding municipal infractions. Motion by Ladegaard, seconded by Olson, to approve first reading of Ordinance No. 120. Roll call vote. All ayes. Motion carried.

Council to review and consider 28E Agreement with the City of Arnolds Park – Vacation Coverage:
Motion by Petersen, seconded by Olson to adopt 28E Agreement with the City of Arnolds Park – Vacation Coverage. Roll call vote. All ayes. Motion carried.
Tom Van Overbeke to discuss additional hoist at Jeppeson Road Public Access: Mr. Van Overbeke asked the Council to consider allowing a sixth hoist on the Jeppeson Road Public Access dock. After some discussion between Councilmember’s, Mayor Traughber stated he would like Van Overbeke to contact the IDNR about the feasibility of extending the docks length to allow more room for his request and if granted to come back to the council for further discussion. Councilmember Ladegaard also stated he would like to see a sign in place stating that area is a public access. He also asked City Administrator Ballis to contact the surrounding homeowners of the public access and remind them that area is for public use. Information only. No action taken.
Discussion regarding potential litigation (possible closed session pursuant to Iowa Code Section 21.05 ( c ))
Councilmember Ladegaard stated he was opposed to a closed session, due to the fact that there was no litigation strategy to discuss. He and the council want to simply enforce the Code of Ordinances. He stated City Administrator Ballis should continue working with the city attorney and go forward with the process. Information only. No action taken.
Administrative Reports: Ballis reported she has had a few concerned residents contact her about the trees on city owned property at the Maywood Ravine. It seems a couple residents in the area feel they can cut them down and or trim them in the ravine. She stated she has informed the parties involved that this is not permitted and that trees on city property are not to be altered by residents. The Council agreed and asked Ballis to get the word out that this is not permissible in the City of West Okoboji.
Ballis informed the Council that a Board of Adjustment meeting would be taking place on July 13 at 2 pm to discuss a variance request by Pete Cannon and a Special Exception Use Permit by Alliant Energy.
Ballis reminded the Council that she would be gone July 16-28 to attend training in Ames.
Petersen/Ladegaard moved to adjourn. All ayes. Mayor Traughber adjourned meeting 7:32 P.M.
